These Terms of Service govern your use of midnightsupplyshop.com and any purchase you make from Midnight Supply LLC ("Midnight Supply," "we," "us"). By using this site or placing an order, you agree to these terms.

1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to make a purchase or enter into a binding agreement with us.

2. Our Products
Midnight Supply sells single-use novelty and convenience kits, including personal care, recovery, and entertainment items. Products are sold for personal, non-medical use unless otherwise stated.

The BAC Kit's digital breathalyzer is intended for entertainment and general reference purposes only. It is not a certified or medically calibrated device, and results should never be used to determine whether it is safe to drive. Always use independent judgment and arrange alternate transportation if you have been drinking.

3. Vending Machine & Retail Locations
Some Midnight Supply products are also sold through vending machines at third-party venues (such as bars and restaurants). We are not responsible for the conditions, policies, or conduct of any third-party venue where our machines are located.

4. Orders & Payment
All prices are listed in U.S. dollars. We reserve the right to refuse, cancel, or limit any order at our discretion, including in cases of suspected fraud or pricing errors. Payment is processed securely through Shopify.

5. Wholesale Accounts
Wholesale pricing and ordering is available only to approved business accounts. We reserve the right to approve, deny, or revoke wholesale access, and to change wholesale pricing, minimum order quantities, or terms at any time.

6. Shipping & Returns
Shipping and return terms are set out in our Shipping Policy and Refund Policy, which are incorporated into these Terms by reference.

7. Intellectual Property
The Midnight Supply name, logo, product designs, and website content are the property of Midnight Supply LLC and may not be used, copied, or reproduced without our written permission.

8. Limitation of Liability
To the fullest extent permitted by law, Midnight Supply is not liable for any indirect, incidental, or consequential damages arising from the use or misuse of our products, including reliance on the BAC Kit for decisions about alcohol consumption or driving.

9. Governing Law
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles.

10. Changes to These Terms
We may update these Terms from time to time. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
